Yes, the Article 23-A saga continues.  Last week I received a call from a client for further clarification.  If you are giving the Pre-Adverse Action Notice to an applicant because you do not plan to hire them based upon our background investigations report, you need to include the Article 23-A notice with the FCRA notice, copy of the report and Pre-Adverse Action form.
